The purpose of this study is to explain whether the plan to change the status of Teluk Kapuas village into kelurahan in district of Sungai Raya Kabupaten Kubu Raya is feasible and meets the requirements in terms of philosophical, sociological and juridical aspects. The research method used in this research is Descriptive method with normative and empirical juridical approach by using secondary data and primary data which analyzed qualitatively. Methods of data collection from this study are interviews, observations, and documentation studies in the form of proposals of pemekaran desa and others. Techniques to establish data validity are: credibility, transferability, dependability, and confirmability. Data analysis technique used in this research is data analysis technique model of Miles and Hubberman that is data reduction, display data and withdrawal conclusion. The results showed that: the philosophical, sociological, and jurisdiction of Teluk Kapuas Village based on the requirements established by Law no. 6/2014 on the Village and administrative requirements set forth in the Minister of Home Affairs Regulation no. 1/2017 on Village Arrangement has been fulfilled and deserves to change status to kelurahan
This article analyzes the rejection of an application for child marriage dispensation at the Sukadana Religious Court, Indonesia. Normatively, building a family and preserving the lineage are human rights, but the judges reject the application for the marriage dispensation. This normative research used observation, interviews, and documentation to collect data. In rejecting the marriage dispensation, the Religious Court judges used two arguments: normative (fiqh rules) and juridical (regulations related to human rights). The legal arguments integrate Islamic values (benefits and avoiding disgrace) with human rights principles. They seek to protect the petitioners' human rights, especially children's rights. From the finding above, the researchers suggest that there is no conflict between Islam and human rights. Both harmonize in their value of protecting the citizens. This study has implications for the increased unregistered marriages that do not have legality.
The aim of this research is to study and analyze how the implementation of smart governance in the city of Balikpapan, how to strengthen local resources in the implementation of smart governance in the city of Balikpapan, and how to strengthen local government resources in supporting Smart Governance in Balikpapan City. The results of the analysis and discussion was found that the implementation of smart governance in the city of Balikpapan in serving the needs of the community could be carried out well if coupled with strengthening local government resources that include institutions, budgets and IT apparatus on the dimensions of local government, and increasing community participation and community use towards applications in the community dimension.
This research aims to reveal the historical roots and elements of the background for the formation of the Orang Rimba’s religion. This study is based on field research with a descriptive approach of religious phenomenon. The research derives some conclusions: (1) the Orang Rimba is monotheist, that is, they are not adherents to dynamism, polytheism, or animism as it has been understood. (2) The history of the Orang Rimba’s religion is affected by two elements; namely, Rimba culture and Islamic culture. (3) Evidence suggests that Islam is one element of Orang Rimba’s religion as the following: (a) Mantra of Getting Honey, such as Basmallah, Allah, Istighfar, Muhammad and Ya Karim; (b) Orang Rimba Faith in God, the Prophet Muhammad, the Angel and Doomsday; (c) the values of the ceremony of Death: Ratib Laa Ilaha Illallah; and (d) the values of the ceremony Berdekir. (4) It has proved the existence of a new theory about the spread of Islam in the Suku Anak Dalam community since the 14th century and at the same time undermined the old theory of the Orang Rimba’s religion that has been misunderstood over the years.Contribution: Researchers can use this new theory’s findings as reference material on the Orang Rimba’s religion (Suku Anak Dalam). They can also use this theory to compare other views about the Orang Rimba’s religion.
