The research aims at studying the policy of the Regional Government in protecting the victims of human trafficking, especially females and children. This legal research is based on an empirical study at Regional Police (POLDA), P2TP2A, and Social Services office in Jambi Province. The Law Number 35/2014 on the Amendment of The Law Number 23/2002 on Child Protection provides a greater portion for the Regional Government to take active roles in providing child protection and Presidential Regulation Number 69/2008 about Task Force Prevention and Handling the Criminal Act of Trafficking Victim. Using analysis of descriptive qualitative, it is learned that the handling of the women and children as victims of trafficking remain partially. The responsible institutions have not well-coordinated because a task force as commissioned by Presidential Regulation number 69/2008. The results show that Jambi Province has passed Jambi Province Regional Regulation Number 2/2015 on Prevention and Handling of Human Trafficking towards Females and Children. However, the study also shows that the regulation has not been applied by related parties since Governor’s regulation as implementing regulation is inexistent.
This article is the result of research with the aim of analyzing and examining the principles in the implementation of the National Social Security System by BPJS Kesehatan in Jambi City. Then it aims to study and analyze the problems and efforts to overcome the problems. The research carried out is a type of empirical research, which concentrates on the main data from the field. The sampling method is through the 'accidental sampling' technique. The result of the research states that the humanitarian principle and the principle of benefit have mostly been implemented in BPJS services at the Hospital in Jambi City. Only the principle of social justice for all Indonesian people is still obscured and its implementation has not yet been seen in the implementation of health services by BPJS at Jambi City Hospital. Furthermore, there are still problems in the implementation of the BPJS in Jambi City, namely some of the losses in the implementation of the National Health Insurance, the unfairness of claims by participants in certain groups, unequal facilities and health workers in Hospitals.
This article discusses about the legal protection of capital owners in the investment activities in Jambi City which is based on the regional regulation of Jambi city as well as obstacles faced by investment actors in the implementation of capital investment in Jambi City. This discussion is necessary because the development of investmentin the city of Jambi is increasing in line with the development of the time in line with the law number 25 in 2007 on investment that was formed as the basis of consideration is to accelerate the development of national economy and realize Indonesia's political and economic sovereignty. This research is using juridical research method empirical with results that shows the legal protection of capital owners in investment activities has been supported through the Department of Investment and Integrated services Jambi to facilitate the owner of capital in obtaining business licenses. Constraints encountered by capital owners in the activities of capital keeping in Jambi city caused by the number of licensing requirements that must be fulfilled by the capital owner to start the business and Online Single Submission (OSS) system that has not been carried out with maximum because the owner of the capital remains to carry out the licensing manually and independently to the government agencies authorized to issue operational licenses of the company. Keywords: Legal; Protection; Investment; Abstrak Artikel ini membahas bagaimana perlindungan hukum terhadap pemilik modal dalam kegiatan investasi di Kota Jambi yang didasarkan pada Peraturan Daerah Kota Jambi serta kendala yang dihadapi pelaku investasi dalam pelaksanaan kegiatan penanaman modal di Kota Jambi. Pembahasan ini diperlukan karena perkembangan iklim investasi di Kota Jambi yang semakin meningkat sejalan dengan perkembangan zaman sejalan dengan Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal yang dibentuk sebagai dasar pertimbangan yaitu untuk mempercepat pembangunan ekonomi nasional dan mewujudkan kedaulatan politik dan ekonomi Indonesia. Penelitian ini menggunakan metode penelitian yuridis empiris dengan hasil yang menunjukan perlindungan hukum terhadap pemilik modal dalam kegiatan investasi telah di tunjang melalui Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu Kota Jambi untuk memudahkan pemilik modal dalam memperoleh izin usaha. Kendala yang ditemui pemilik modal dalam kegiatan penaman modal di Kota Jambi disebabkan banyaknya persyaratan perizinan yang harus dipenuhi oleh pemilik modal untuk memulai usaha serta sistem Online Single Submission (OSS) yang belum terlaksana dengan maksimal karena pemilik modal tetap harus melakukan perizinan secara manual dan tersendiri ke instansi pemerintah yang berwenang dalam mengeluarkan izin operasional perusahaan. Penelitian ini bertujuan untuk mengetahui dan menganalisis pelaksanaan ganti kerugian tanah milik masyarakat atas pembuatan instalasi air bersih oleh Dinas Perumahan dan Kawasan Permukiman Kabupaten Merangin; dan untuk mengetahui dan menganalisis hambatan yang dihadapi oleh Dinas Perumahan dan Kawasan Permukiman Kabupaten Merangin dalam pelaksanaan ganti kerugian tanah milik masyarakat atas pembuatan instalasi air bersih. Masalah yang diangkat yaitu bagaimana pelaksanaan ganti kerugian tanah milik masyarakat atas pembuatan instalasi air bersih oleh Dinas Perumahan dan Kawasan Permukiman Kabupaten Merangin dan apa saja hambatan yang dihadapi oleh Dinas Perumahan dan Kawasan Permukiman Kabupaten Merangin dalam pelaksanaan ganti kerugian tanah milik masyarakat atas pembuatan instalasi air bersih. Metode yang digunakan adalah tipe penelitian yuridis empiris. Hasil penelitian menunjukkan bahwa bentuk dan mekanisme ganti rugi pelaksanaan ganti kerugian tanah milik masyarakat atas pembuatan instalasi air bersih oleh Dinas Perumahan dan Kawasan Permukiman Kabupaten Merangin belum berjalan sebagaimana mestinya seperti yang ditentukan dalam ketentuan KUHPerdata dan UUPA dan hambatan yang dihadapi dalam pelaksanaan ganti kerugian tanah milik masyarakat atas pembuatan instalasi air bersih oleh Dinas Perumahan dan Kawasan Permukiman Kabupaten Merangin, yaitu kendala yang timbul dari dalam Dinas Perumahan dan Kawasan Permukiman Kabupaten Merangin dan kendala yang timbul dari kedua pihak yang bersengketa. The problem raised is how the implementation of compensation for land owned by the community for making clean water installations by the Merangin Regency Housing and Settlement Office and what are the obstacles faced by the Merangin Regency Housing and Settlement Office in implementing compensation for community owned land for making clean water installations. . The method used is empirical juridical research type. The results showed that the form and mechanism of compensation for the implementation of compensation for land owned by the community for the installation of clean water by the Department of Housing and Settlement of Merangin Regency has not been running as it should as determined in the provisions of the Civil Code and the LoGA and the obstacles encountered in implementing compensation for land owned the community on the making of clean water installations by the Merangin Regency Housing and Settlement Office, namely the constraints arising from the Merangin Regency Housing and Settlement Office and the constraints arising from both parties in dispute. Proses penyidikan tindak pidana penipuan menggunakan media elektronik tidak ada bedanya dengan proses penyidikan Tindak pidana biasa, namun dalam proses penyidikan tindak pidana penipuan melalui media elektronik pihak penyidik Polresta Jambi mengalami hambatan dan kendala. Hanya sedikit kasus yang dapat terselesaikan karena adanya kendala yang sulit dipecahkan untuk menemukan tersangka yang melakukan tindak pidana penipuan melalui media elektronik salah satu sebabnya lemahnya personil penyidik dalam ilmu Informasi dan Teknologi, sulitnya mencari identitas tersangka, karena biasanya tersangka menggunakan identitas palsu. Oleh sebab itu penulis tertarik untuk melakukan penelitian menganai proses dan kendala Penyidikan tindak pidana Peniluan melalui media ektronik di Polresta Jambi.
