Law Number 1 of 2011 in Article 98 paragraph (3) concerning Housing and Settlements, it is explained that the regional government has the authority to conduct arrangements and determine the location of slum housings and urban slums. This is what underlies the Regional Government of Siak Regency to have a role in identifying various local wisdoms in its region. The existence of the local wisdom of the indigenous people of Siak can be viewed from the legal aspect of structuring the location of housing and slums as mandated by legislation and implemented in the Letter Regent Decree Number 523/HK/KPTS/2014 concerning Determination of Slum and Slum Housing Locations in Siak Regency and Regent Decree Number 302/HK/KPTS/2017 concerning Slum and Slum Residential Housing Locations in Siak Regency. The result is the existence of the local wisdom of Indigenous people of Kampung Buatan II, Koto Ghasib Subdistrict did not work optimally, because it had not maximized the role of the Riau Malay Customary Institution in Siak Regency. However, the noble values of local wisdom in Malay indigenous communities in structuring the location of housing and slums are known from their ancestors expressed in a proverb or customary expression in preserving nature around us to create a clean, healthy life by understanding the meaning of development, understanding the ins and outs of religion and culture and the social norms of the people, so that development is truly beneficial for all levels of society.
Riau is one of the provinces in Indonesia that borders directly with several ASEAN countries. Apart from that, Riau has abundant natural resources that give benefits for improving the welfare of the people of Riau. Almost all districts have the potential to find natural resources, such as coal, granite, kaolin, etcetera, as well as plantation products such as oil palm, rubber and cocoa, and various other investment potentials. After going through a long process, the implementation of the AEC (ASEAN Economic Community) is a must and Indonesia must be prepared to face existing challenges, especially in investment negotiations. The research method used is legal, sociological research, and by using primary legal materials and secondary legal materials. The Riau Provincial Government has issued regional regulations aimed at encouraging investment in Riau. However, government regulations regarding other investments must be harmonious with the provisions of the AEC while taking into account national regulations and the interests and potential of the Riau Province.
Customary law is religiously functional law, so that customary law fulfills a social function or social justice. Thus, the community and its members carry out these normative orders without seeing them as coercion, but because they assume they are as such. The aim of the law is justice, expediency and legal certainty, and these three elements constitute an inseparable unity. Justice is the moral foundation of the law and, at the same time, the benchmark for a positive legal system. In other words, justice has always been the basis of the law. Without justice, a rule can not be called a law. The highest possible justice to be achieved in the mediation of sanctions is the agreement of the parties involved in the criminal case.
Problems related to the settlement of customary disputes in the Akit tribal community in Titi Akar Village, Bengkalis Regency, were carried out by traditional settlement efforts. Elderly people/smart people or better known as bono people have an important role in efforts to resolve customary disputes. State law or law as regulated in civil law/Civil Code does not apply to the Akit Tribe community in Titi Akar Village. For indigenous peoples who violate customary law or a dispute occurs, the settlement through the Head of the RT will be subject to a fine. The penalty is calculated by the value of the currency used to compensate for the losses suffered by one of the parties.
In a community there is a reflection that can describe the state of a particular society, because in the process of interaction between individuals in the group or community it will potentially cause a conflict because each individual has different interests. The purpose of this study is to find out the rules or customary law of the Akit Tribe community in resolving disputes over violations of customary criminal law. The research method used in this study is to use the normative method through document study using secondary data and analyzing various studies on the akit tribe. In addition to collecting secondary data, this research will also be supported by primary data through indepth interviews with traditional leaders, the Akit Tribe community and government officials. Based on the results of the study, the process of resolving violations of customary criminal law in the customary law community of the Akit tribe in Bengkalis Regency was carried out through a consensus deliberation process involving traditional officials, the police and village officials. The process of resolving violations of customary criminal law prioritizes solutions for these criminal events, the solution here is not only sought to punish the perpetrators but also find solutions for victims of these crimes, both victims who experienced the crime itself and the families of the victims who participated and feel the consequences of a crime.
