E-wallet is one of the most popular medium for digital transactions in Malaysia. With the wide variety of services provided by e-wallet companies, users find it convenient, faster and more efficient to do transactions. The application of e-wallet can be evaluated through the scope of hifz mal (preservation of property) of maqasid shariah so that it is always in compliance with shariah. The objective of this study is to discuss the application of hifz mal in e-wallet. The research methodology used is qualitative based on content analysis technique to obtain data. This study reviewed comprehensive articles and books relating to e-wallet, and views of Islamic scholars on the concept of hifz mal. In addition to the Central Bank of Malaysia (BNM), references were made to websites to obtain information on electronic money guidelines. Research findings show that using e-wallet as a medium for electronic transactions to purchase products or services is in line with the concept of hifz mal. Using money stored in e-wallet as medium of exchange in digital transactions is gaining wide public acceptance and does not involve elements of riba, gharar, gambling, and exploitation. In addition, e-wallet provides high security features and multiple maslahah that can facilitate people’s lives, which are in line with the principle of preserving property in maqasid shariah.
‘Iddah or waiting period is a specific period stipulated for a woman who was divorced or after the death of her husband. It is an aspect that needs to be observed after a divorce occurs, other than maintenance and custody. In reality, many women who are observing the waiting period are involved in a career and social activities which leaves certain implications and creates challenges as to the actual process of waiting period as stipulated by Islam. Hence, this conceptual paper aims to review the sharī‘ah rulings on some common activities that these women who are separated by revocable divorce were involved in, such as in the aspects of career, appearance and celebratory occasions. Qualitative methodology was adopted by collecting and analyzing Muslim jurists' opinions on social activities that the women who are observing waiting period of revocable divorce are involved in. This study found that the opinions of Muslim jurists and their discourse on legal sources on the basis of legal objectives (Maqāṣid al-Sharī'ah) can determine the status of involvement in social activities among women who were revocably divorced and observing the waiting period.
The reality of family in Malaysia shows that the trend of divorce is increasing every year. There are many factors that lead to divorce and one of the factors that recorded the highest percentage is lack of understanding. Couples who divorce due to misunderstanding have their own reasons for divorce. Therefore, this study aims to identify the factors that cause disagreements between husband and wife. This study uses data analysis methods from 15 case files with specialization on the reason for divorce due to lack of understanding from 2017-2022. The study was conducted at Shah Alam Syariah Subordinate Court. Among the aspects studied are the age of the husband and wife, the duration of the marriage and the reason for disagreement. The results of the study show that misunderstanding often occurs due to communication problems, maintenance problems and neglect of the couple's feelings which is the most important factor, in addition to other factors such as neglect of religious responsibility and health problems.
