Purpose The purpose of this paper is to identify the conditions of the wajibah (obligatory) will under compilation of Islamic law (KHI) and the application and rationale of wajibah wills in religious justice. The wajibah will is a form of judicial wealth transition that can deliver an inheritance to an heir who is not otherwise eligible for it. It is implemented in some Islamic countries, including Indonesia, based on the KHI. Design/methodology/approach This is a descriptive qualitative study that uses documentation as a data-collection method. This study applies the content-analysis method to the data collected. Findings The results of study indicate that, under KHI, a wajibah will only be given to adopted children. Nevertheless, in the practice of religious justice, the wajibah will is also granted to heirs of faiths other than Islam and to illegitimate children. The rationale for the wajibah will involves historical factors and public considerations. Originality/value This paper provides information on the practice of the wajibah will in Indonesia in view of the plurality of the Indonesian people. Thus, the wajibah will is an appropriate instrument to attain justness in the well-being of the community. This paper also attempts to give a critical review of the practice based on five necessities.
Sekarang ini, banyak pergeseran nilai terjadi dan pada akhirnya akan berpengaruh terhadap syariah termasuk hukum kewarisan Islam. Hal ini yang mendorong para pemikir Islam untuk melakukan rekonstruksi agar hukum Islam shalih likulli zaman wa makan dapat dirasakan. Penelitian ini bertujuan untuk menjelaskan bagaimana kedudukan maqashid yang digunakan dalam merekonstruksi hukum Islam di bidang kewarisan dan bagaimana posisi maqashid pada beberapa masalah dalam kewarisan Islam. Penelitian ini merupakan kajian kepustakaan dengan menggunakan content analysis dalam menganalisis data. Hasil penelitian ini menunjukkan bahwa maqashid yang terdapat dalam rekonstruksi hukum kewarisan Islam terutama dalam pembagian laki-laki dan perempuan adalah untuk mencapai keadilan yang merata, sementara pada pemberian wasiat wajibah kepada ahli waris non muslim dalam rangka memelihara keturunan. Sedangkan maqashid yang dikehendaki oleh Islam sendiri terhadap kedua persoalan tersebut adalah keadilan berimbang dan memelihara agama. Oleh karena itu, perlunya pengkajian ulang terhadap rekonstruksi suatu hukum agar tidak mencederai ketentuan syariah itu sendiri.

The contemporary Malay community is increasingly facing a wedding expenses issue following the existence of various pre-wedding preparations, including the demand of customary rites and current reception trends. In order to face this issue, preparing a source of expenditure is one of the elements that should be considered much earlier. Thus, by not prioritising matters related to the source of expenditure, it could have an effect on managing expenditure. Hence, this study explored the sources of wedding expenditure among the Malay-Muslim community. This study was qualitative in nature and involved 30 couples selected through the purposive method, who then participated in a semi-structured personal interview session. The recording of the interview was transcribed and analysed according to the thematic method as stipulated in this study. By using the ATLAS.ti version 7.5.6. software, the data were investigated and later coded and categorised based on the characteristics of the data in order to adduce the themes related to the phenomenon being studied. The findings showed that there were four sources of expenditure used by the respondents in the study, namely savings, contributions, loans and special funds. Out of the four, three are endorsed by Islam, except loans.
