This study wants to examine the suitability of Aceh Qanun with National Law related to the Hierakicity of laws and regulations in Indonesia. In theory it is possible that the Aceh Government can build its own hierarchies that are not the same as the Central Government. This relates to the authority of the Aceh Qanun which is not the same as the Regional Regulation but the hierarchy that is built but meets the basic norms of the Indonesian constitution. There are two focuses which are the focus of this research. First, what is the character of the Aceh Qanun as a legal umbrella in the implementation of post-autonomy Aceh and post-peaceful Aceh? Second, What Is the Future of Law in Aceh? The results of the first research, the character of the Aceh Qanun as a legal umbrella in the implementation of post-autonomy Aceh and post-peaceful Aceh is expected to be able to build Aceh better because of the presence of Law Number 18 Year 2001 and Law Number 11 Year 2006 regarding new hopes for the people of Aceh itself specifically in the field of Islamic sharia. Second, the future of law in Aceh in the discussion of legal development, is greatly developing from creating new norms in Aceh Qanun Number 6 of 2014 concerning Jinayah Law, because regulating jinayah law in Aceh does not have to draw the Criminal Code or the Criminal Procedure Code.
<p><strong>Abstrak:</strong> Aceh justru telah melahirkan sebuah KUHP versi Aceh yang lumrah disebut Qanun Jinayat Aceh pada 2014 silam, di tengah pembicaraan tentang Rancangan Kitab Undang-Undang Hukum Pidana (RKUHP) Nasional. Sebagai bagian dari wilayah Indonesia, keadaan demikian menimbulkan polemik terjadinya perbedaan (dualisme) hukum antara Aceh dan wilayah lain di Indonesia dalam menanggulangi kejahatan. Dinamika pemidanaan itulah yang menjadi fokus dalam artikel ini. Penelitian ini menunjukkan adanya keunikan dalam Qanun Jinayat Aceh yang patut dijadikan stimulus bagi pembangunan hukum pidana nasional. Di samping itu, reorientasi pemidanaan di Aceh patut menjadi agenda lain demi terintegrasinya Aceh ke dalam sistem hukum pidana nasional. Keistimewaan tidak harus dimaknai sebagai pembeda, melainkan penguat bagi kesatuan sistem hukum di mana Qanun Jinayat Aceh merupakan bagian dari sub-sistem hukum pidana tersebut.</p><p><strong>Abstract:</strong> The Position of Aceh Criminal Code in Indonesian National Criminal Code System. In the amidst discussions on the National Criminal Code (RKUHP) draft, Aceh has produced a version of Aceh Criminal Code-commonly referred to as Aceh Qanun Jinayat in 2014. As part of the Indonesian territory, such circumstances certainly bring about a lot of polemics. Among the polemics is the legal difference (dualism) between Aceh and other parts of Indonesia in overcoming the crime. This article focuses on the dynamics of the crime. The study shows the uniqueness of the Aceh Qanun Jinayat which should be a stimulus for the development of the national criminal law. In addition, the reorientation of punishment in Aceh should be another agenda for the sake of Aceh integration into the national penal system. This privilege should not be interpreted as a differentiator, but a reinforcement of the unity system where Aceh Qanun Jinayat is a part of sub-system of criminal law.</p><p><strong>Kata Kunci:</strong> Aceh, hukum pidana, qanun, jinayat</p>
Purpose: This study aims to analyze the potential of Zakat in distribution income policy and the causality relationship of Zakat income inequality and poverty. Design/Methodology/Approach: This study analyzes the causal relationship and the effect of Zakat, income inequality on poverty in 21 districts/cities of Aceh-Indonesia. To see the effect in the short and long term, time series analysis with Auto-Regressive Distributed Lag (ARDL) is used. The stages of the analysis test were carried out starting from the data stationarity test, optimal lag, cointegration test, and causality test. Findings: The estimation results show that in the long run, Zakat has a negative effect on poverty and income inequality has a positive effect on poverty. However, in the short run, both Zakat and income inequality do not affect poverty. Supported by the results of the causality test which shows that there is a one-way causal relationship between Zakat and poverty and Zakat with income inequality. Likewise, income inequality has a one-way causal relationship to poverty. Practical Implications: The findings of this research indicate that if the Zakat potential can be distributed optimally, then Zakat is the best policy solution to reduce poverty and income inequality. Originality/Value: The difference in this research from previous studies is to review the potential for Zakat that has become a regional policy in Aceh and to test it against poverty alleviation using the income inequality variable as a control variable. The analysis is strengthened by analyzing the causal relationship between the three variables.
Zakat as a wealth distribution mechanism has an impact on reducing poverty as the most important point in achieving the sustainable development goals (SDGs). An important role can be played by zakat institutions in reducing poverty levels, especially zakat institutions in regions in Indonesia. This study aims to explain the mechanism of zakat as an instrument of Islamic economy in order to contribute to the achievement of SDGs in Aceh Province by optimizing the role of the Aceh Baitul Mal. With the grounded research method, this research is carried out by collecting data through interviews with academics of Islamic studies, Islamic boarding school scholars and zakat practitioners who are competent to assess the role of zakat in poverty alleviation in Aceh. The results showed that to achieve the sustainable development goals (SDGs) Baitul Mal Aceh must optimize zakat as a transfer of wealth from muzakki to mustahik, both optimizing the collection and optimizing the distribution of zakat. Optimization of zakat collection is carried out by means of education, socialization, and good zakat services, while optimization of distribution is carried out by prioritizing zakat for poverty alleviation programs, ensuring the accuracy of zakat recipients, and distribution using consumptive and productive methods.
