Zakâh, Infâq, and Shadaqah: The Capital and Ideal Model of Modern Finance and Economic Development. Zakat is the designation for a particular property that intentionally released to be channeled to mustahiq. Other financial types that always accompanies or included with it are zakat, infak and sedekah. ZIS funds can be considered as a triad of economic resources and short-term Islamic finance in synergy with other funding sources, such as grants, wills, and endowments-oriented for long-term interests. In addition to its management structure and mechanism is relatively simple and efficient, zakâh can be said always completely ready to cope with urgent needs. ZIS funds in enforceability of all peoples and Muslim nations showed that zakâh system appropriate to be used as capital and financial economic model and the most modern of all time.
Measuring the Justice of Islamic Inheritance Law by Drawing upon the Text and Context of al-Nushûsh. Accusations against the Islamic inheritance distribution system are surfacing again. Several groups are finding fault with the 2:1 distribution for Islamic inheritors. They suggest this distribution method be converted into 1:1, like it is in the Western system of inheritance and like it is to some extent in Adat inheritance law. This study points out that theoretically Islamic inheritance law looks very clear, comprehensive and fair, from whatever angle you look at it. This takes into account, in a balanced way, the distributions that use the 2:1 approach for joint male and female heirs. The key to understanding this is inheritance has to be treated entirely as a sub-system of the family law system, and even has to be understood as an integral part of the whole Islamic legal system, which is sound and comprehensive.Keywords: justice, inheritance law, textual, al-nushûshAbstrak: Menakar Keadilan Hukum Waris Islam Melalui Pendekatan Teks dan Konteks al-Nushûsh. Gugatan mengenai sistem pembagian kewarisan Islam kembali muncul ke permukaan. Beberapa kalangan mempermasalahkan perimbangan waris Islam 2:1. Mereka menawarkan metode perimbangan ini menjadi 1:1, sebagaimana pada sistem hukum kewarisan Barat dan sebagian hukum kewarisan Adat. Studi ini menunjukkan bahwa dari sisi mana pun hukum kewarisan Islam secara teoretik tampak sangat jelas, lengkap, dan adil. Termasuk dalam konteks perimbangan pembagiannya yang menggunakan pendekatan 2:1 untuk ahli waris laki-laki dan ahli waris perempuan. The research aims to analyze and examine the problematic factors of the philosophical, sociological, and juridical problems of the Law on Halal Product Guarantees and the Law on Job Creation and analyze the implementation constraints based on the facts and how they are sustainable. The research method used in this research is the normative juridical method. The results of the study found that halal certification in the Law on Halal Product Assurance must be intervened by the government to maintain the interests of maslahah , especially consumer protection for the halalness of a product, the government is also required to act as a facilitator, regulator, and supervisor. Other factors that cause derivative regulations from the Law on Halal Product Assurance are also constrained, namely: sectoral ego and overlapping regulations, government competence where BPJPH is the leading sector, and overlapping interests. The results of this study also show that the new sanctions arrangement in the Law on Job Creation does not reflect legal certainty, the change in the form of administrative sanctions in the Law on Job Creation sees only the ease of doing business without considering the impact of the violation committed; the regulation is still weak and allows business actors to violate statutory norms; shows the loss of the authority of sharia which is the spirit of the Law on Halal Product Guarantee. Therefore, to strengthen the Law on Halal Product Assurance and the Law on Job Creation, technical implementing regulations are needed that can strengthen and accommodate existing weaknesses.
