Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktek Monopoli Dan Persaingan Usaha Tidak Sehat mengecualikan pelaku usaha kecil yang berarti larangan menurut undang-undang tidak berlaku bagi pelaku usaha kecil. Larangan ini menimbulkan pro-kontra sejak pembahasan RUU di tahun 1998. Di sisi lain Hukum perlindungan konsumen hadir sebagai upaya untuk memberikan perlindungan terhadap konsumen dari perilaku pelaku usaha yang melanggar hak-hak konsumen, dimana kerugian konsumen salah satunya disebabkan oleh persaingan usaha tidak sehat. Tulisan ini bertujuan untuk menganalisis ketentuan pengecualian pelaku usaha kecil menurut hukum persaingan usaha Indonesia dengan upaya melindungi konsumen berdasarkan undang-undang perlindungan konsumen. Metode penelitian yang digunakan adalah penelitian hukum normatif yang bersifat deskriptif. Hasil kajian menunjukkan bahwa ketentuan pengecualian pelaku usaha kecil dari hukum persaingan usaha di Indonesia, berakibat pelaku usaha kecil dapat menjalankan kegiatan usaha dengan tidak sehat, seperti melakukan perjanjian penetapan harga, pembagian wilayah, dan bentuk persaingan usaha tidak sehat lainnya yang dapat merugikan masyarakat sebagai konsumen. Benturan antara upaya melindungi pelaku usaha kecil menurut hukum persaingan usaha dengan upaya melindungi konsumen dalam hukum perlindungan konsumen. Ketentuan pengecualian terhadap pelaku usaha kecil perlu mendapat perhatian lebih mendalam, dalam rangka membangun dan menuju hukum yang berkeadilan bagi seluruh rakyat Indonesia.
Notary public in carrying out their profession to provide services and legal services to the community need to get protection and guarantees in order to achieve legal certainty. Guarantee of protection and guarantee of legal certainty on the implementation of notary duties and functions has been stipulated in the Law of the Republic of Indonesia Number 2 of 2014 concerning Amendments to Law No. 30 of 2004 concerning Notarial Positions. This change in the legal basis is intended to further affirm and strengthen the duties, functions, and authority of notary public officials as well as synchronize with other laws. The role of the Notary Department in Indonesia as well as in Pekanbaru City is very important for the community in solving various legal problems faced by the community, one of which is in issuing authentic deed. The professional rights of notary positions, especially regarding civil rights, ideally should get legal protection in carrying out their profession, but in fact Notaries in carrying out their duties often do not get legal protection as they should, as a result notary are faced with civil or criminal legal proceedings.
The sale and purchase is known as novation as long as the sale and purchase is carried out by the debtor with written approval from the bank as the creditor, but in practice the sale and purchase of collateral objects by the debtor to a third party without the approval of the bank as the creditor sometimes also occurs and causes problems in the future. This study aims to provide a prescription regarding the implementation of a lawful cause for the legality of the deed of sale and purchase of land by the debtor without the approval of the creditor. This research method is a normative legal research, using a statutory approach, a conceptual approach, and a case comparison approach, the case used in this research is the District Court Decision Number 7/Pdt.G/2019/PN.Rhl which is confirmed by the Court's Decision Pekanbaru High Court with Case Number 85/PDT/2020/PT PBR was further reaffirmed by the Supreme Court of the Republic of Indonesia with Decision Number: 1600 K/Pdt/2021 so that it has permanent legal force or inkracht."The results of the study can be concluded that the deed of sale and purchase agreement on the land negates the point of lawful cause as one of the fundamental requirements in contract law, b. the deed of sale and purchase of land is contrary to the Mortgage Law, c. the decision was in accordance with the principles of formal justice.
The phenomenon in this study is the placement of PSP-3 participants, the activities of PSP-3 participants and the Cost of Living for PSP-3participants that have not been implemented in accordance with the stages of program implementation and guidebooks for implementing the PSP-3 program. The purpose of this study was to find out and analyze the Implementation of the Rural Development Program for Youth Development in the Department of Youth and Sports of the Regional Government of Riau Province in 2016, and to find out the obstacles or symptoms that made the implementation of the Bachelor Youth Program Driving Rural Development in the Youth Service and Sport of the Provincial Government of Riau in 2016. The indicators of assessment in the study of the Evaluation of the Implementation of the Undergraduate Youth Program Driving Rural Development in the Department of Youth and Sports of the Provincial Government of Riau in 2016 include Inputs, Processes, Outputs, Income. And this study uses Qualitative research methods, namely prioritizing interview lists, documentation as a tool for collecting data and data collected with this tool and then used as the main raw material to analyze the empirical conditions of the objectivity of the existence of research objectives at the meticulous location. The population in this study included the Head of the Riau Province Youth and Sports Office, the Head of the Youth Division of the Riau Province Youth and Sports Office, the Head of the Siak Regency Youth and Sports Office, the Kampung Tengah Village Head, the Mempura River Village and PSP-3 Participants in Siak Regency. Based on the results of the study assessing and concluding that the Evaluation of the Implementation of the Undergraduate Youth Driving Program in Rural Development at the Office of Youth and Sports of the Regional Government of Riau Province in 2016 was in the assessment of Not Implemented Well.
Notaris dalam menjalankan profesinya memberikan jasa dan pengabdian hukum kepada masyarakat perlu mendapatkan perlindungan dan jaminan demi tercapainya kepastian hukum. Jaminan perlindungan dan jaminan tercapainya kepastian hukum terhadap pelaksanaan tugas dan fungsi Notaris telah diatur dalam Undang-Undang Republik Indonesia Nomor 2 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris. Perubahan dasar hukum ini dimaksudkan untuk lebih menegaskan dan memantapkan tugas, fungsi, dan kewenangan Notaris sebagai pejabat yang menjalankan pelayanan publik, sekaligus sinkronisasi dengan undang-undang lain. Peran dari Jabatan Notaris di Indonesia demikian juga di Kota Pekanbaru sangat penting bagi masyarakat dalam penyelesaian berbagai permasalahan hokum yang dihadapi oleh masyarakat, salah satunya adalah dalam menerbitkan akta otentik. Hak-hak profesi Jabatan Notaris terutama mengenai hak keperdataannya, idealnya harus mendapatkan perlindungan hukum dalam menjalankan profesinya, tetapi nyatanya Notaris dalam menjalankan tugasnya tersebut sering pula tidak mendapatkan perlindungan hokum sebagaimana mestinya, akibatnya Notaris dihadapkan dengan proses hokum perdata atau pidana.
