It is indicated that in the context of the development of Ukraine as a legal state, the modern development of human rights in Ukraine, the evolution of civil society, the development of the legal status of refugees and Ukrainians abroad, migration processes, the study of the issue of the concept of the constitutional and legal status of Ukrainians abroad is of important practical and theoretical importance. The issue of the evolution of political and legal opinion regarding the constitutional and legal status of Ukrainians abroad becomes important considering the modern development of the constitutional and legal status of Ukrainians abroad, migration processes, globalization, the need for effective protection of the rights and legitimate interests of Ukrainians abroad, as well as the preservation of their linguistic and cultural identity. cooperation of Ukraine with Ukrainians abroad, their communities and non-governmental organizations. The evolution of political and legal opinion regarding the constitutional and legal status of Ukrainians abroad has been going on for a long time and has already gone through various stages. As part of the evolution of political and legal opinion regarding the constitutional and legal status of Ukrainians abroad, the following stages can be distinguished:1. The stage from the times of Kyivan Rus until 1917.2. The period of the Ukrainian national liberation struggle of 1917-1922.3. Stage of Soviet Ukraine.4. The stage of formation of the foundations of the constitutional and legal status of Ukrainians abroad in independent Ukraine from August 24, 1991 to March 4, 2004.5. The newest stage of the development of the constitutional and legal status of Ukrainians abroad, which began on March 4, 2004, after the adoption of the Law of Ukraine “On Ukrainians Abroad”. The first of the above-mentioned stages of the evolution of political and legal opinion regarding the constitutional and legal status of Ukrainians abroad is considered in more detail.
It is indicated that in the context of the development of Ukraine as a legal state, the modern development of human rights in Ukraine, the evolution of civil society, the development of the legal status of refugees and Ukrainians abroad, migration processes, the study of the issue of the concept of the constitutional and legal status of Ukrainians abroad is of important practical and theoretical importance.The authors claim that the legal status of refugees is broader than the legal status of ordinary foreigners and stateless persons living on the territory of the state, because refugees enjoy additional rights that other categories of foreigners and stateless persons do not have.It is indicated that the establishment of the foundations of the legal status of refugees by the Constitution of Ukraine also marked the beginning of the process of creating a new type of legal culture of our state and its citizens. At the same time, it is the principles of the legal status of a refugee, being formed outside of the very institution of the constitutional status of refugees, that bring to it the content that causes the need for truly historic changes in our society. Therefore, the growth of scientific interest of constitutionalists in questions of the sources, nature and legal value of the main principles of the constitutional status of refugees is quite natural.It is noted that, without denying either the epistemological or practical value of the approach to understanding and identifying the main principles of the constitutional status of refugees, one cannot fail to notice its one-sidedness, which is a perspective of research in the works of constitutionalist scientists.In addition, it is concluded that modern trends in the development of Ukraine as an independent, democratic and legal state, the need to preserve the unity of the Ukrainian community in the conditions of globalization and modern migration processes, determined the formation and development of the constitutional and legal status of Ukrainians abroad. Ensuring the proper constitutional and legal status of Ukrainians abroad is important for the evolution of the human rights system in Ukraine. The further development of the constitutional and legal status of Ukrainians abroad is promising. Guarantees of the rights of Ukrainians abroad can be divided into economic, political, social, ideological and legal. And the legal (juridical) guarantees of the rights of Ukrainians abroad can be conditionally divided into regulatory and legal guarantees and organizational and legal guarantees.It is noted that the use of positive foreign experience in regulating the constitutional and legal status of Ukrainians abroad under the legislation of their countries of residence can be partially used to improve the constitutional and legal status of Ukrainians abroad under the legislation of Ukraine.
Actualization of development problem of lobbying institution in legal, political and socio-cultural areas is caused not only by practical need in political development of Ukraine, but also by consequence of a general political science theoretical development. This article analyses the study of a powerful resource of political power - groups of pressure in the current political coordinates of Ukraine. Lobbyism is interpreted as a phenomenon conditioned by the peculiarities of American political process and American legislation, but it is emphasized that special mechanisms and methods of pressure on political government by non-governmental structures is inherent in any democratic system of government. It has been found that the system of pressure by "interested groups" is actively forming and operating in Ukraine, however, lobbyism in our country has not received proper coverage and legal regulation. The purpose of lobbying is to consolidate pressure groups’ interests or third parties’ interests in decisions management. It is noted that the methods of lobbyism that contain unlawful actions in spite of external decency (for example, corruption component) are used quite widely. The emphasis is made on the fact that most political decisions are not formed on the level of open official rule, but in the hidden process of rivalry, adaptation and regulation among numerous interested groups. Obviously, political leadership in Ukraine is largely controlled by large business structures. Currently in Ukraine there is awareness about a need in institutionalization of lobbyism as part of political and democratic process, which, under conditions of legally regulated use, can contribute to the formation of a promising strategy for the development of Ukrainian state. It is concluded that dynamics of political space development in Ukraine depend on the constructive interaction between state institutions and pressure groups.
