The arrangement of personal data protection in national law is stipulated explicitly in the regulation of the Minister of the Ministry of communication and Informasi No. 20 of 2016 on the protection of personal data. In Indonesia, there are no rules that accommodate the protection of personal data on financial technology. That can be hazardous when the economic response of technology is not limited to its use. The case of personal data is not contained in the case of a Such hazard that may arise. The case from the theft of personal data, damage to the system that may allow the occurrence of data breaches, misuse of personal data that has been the business ruled itself, or other parties who may access personal consumer data (such as government). The need to set this up is important because private data is a person's privacy right. Still, it can fundamentally be economically valuable for a third party who is about to take advantage of it.
<p>The purpose of this research study is to discuss the legal protection of workers in the form of work agreements, working hours, overtime mechanisms and wages, company facilities that are the rights of workers, and the safety and health of workers in implementing a remote working system based on labor law in Indonesia. The background of this research stems from technology that continues to develop, workers can do many of their activities only with internet channels that do not require them to be in the office, especially with flexible working hours. This is very important to discuss considering that the remote working system is one of the work systems used by several companies for their workers and is mostly used as a work system in carrying out their business activities after the Covid-19 Pandemic. The research method used is a normative juridical research method using a statutory approach, a conceptual approach, and a comparative approach supported by primary, secondary and tertiary legal materials. With this research, there are research results that show that there is a need for special regulations that regulate and accommodate the rights of workers in the implementation of the remote woking system which can be formed by referring to the rules in other countries.</p><p> </p><p>Tujuan dari penelitian ini untuk membahas perlindungan hukum pekerja berupa perjanjian kerja, jam kerja, mekanisme dan upah lembur, fasilitas perusahaan yang menjadi hak pekerja, serta keselamatan dan kesehatan pekerja dalam penerapan sistem <em>remote working</em> berdasarkan hukum ketenagakerjaan di Indonesia. Latar belakang penelitian ini berawal dari teknologi yang terus berkembang, pekerja dapat melakukan banyak kegiatan mereka hanya dengan saluran internet yang tidak mengharuskan mereka untuk berada di kantor, terlebih dengan waktu kerja yang fleksibel. Hal ini sangatlah penting untuk dibahas mengingat sistem<em> remote working </em>menjadi salah satu sistem kerja yang digunakan oleh beberapa perusahaan terhadap para pekerjanya dan lebih banyak digunakan sebagai sistem kerja dalam menjalankan kegiatan usahanya setelah adanya Pandemi Covid-19. Metode penelitian yang digunakan adalah metode penelitian yuridis normatif dengan menggunakan pendekatan perundang-undangan, pendekatan konseptual, dan Pendekatan komparatif yang didukung bahan hukum primer, sekunder dan tersier. Adanya penelitian ini terdapat hasil penelitian yang menunjukan bahwa perlu adanya peraturan khusus yang mengatur dan mengakomodir terkait hak-hak bagi para pekerja dalam penerapan sistem <em>remote woking</em> yang dapat dibentuk dengan mengacu pada aturan di negara-negara lain.</p><p><strong> </strong></p>
This study aims to determine the legal protection for consumers of Indihome internet services who feel they have been harmed by the services provided by Indihome, then further discuss the liability of PT. Telekomunikasi Indonesia as a provider of Internet services to consumers who have sued the problem. This study uses a normative juridical method with a law approach, a case approach and a conceptual approach, with primary and secondary legal sources. The results of the study show that legal protection for consumers also includes consumer rights as regulated in Article 4 of Law Number 8 of 1999 and Article 45 of Law Number 8 of 1999. In addition to demanding rights, consumers must also pay attention to their obligations such as reading or following information instructions and procedures for the use or utilization of goods and/or services, for the sake of security and safety which aims to prevent consumers from things that will harm consumers later.
