The history of the development of the Indonesian financial system, the system of financial institutions underwent a very fundamental change, especially after entering the era of deregulation, the policy package October 27, 1988 which then continued with the enactment of several laws in the field of finance and banking since 1992, starting from the Banking Act, Act Insurance Act, Pension Fund Act, Capital Market Law, until the Bank Indonesia Law. The consequence of the issuance of this law is the change in the structure of the financial institutions in Indonesia. In addition, from the aspect of regulation and fostering, financial institutions are becoming increasingly clear and strong because they already have legal power, especially in the field of insurance and pension funds, which were previously legally regulated only on financial ministerial decisions. This paper analyzes the latest developments in the country's financial system in Indonesia. This paper aims to provide an overview, study, and compare about the developing financial system in Indonesia with several cases of existing financial systems both domestically and abroad. This paper also uses a comparative model of laws, where these laws relate directly or indirectly to the country's financial system.

Sejak tahun 2019, selain persidangan konvensional, Indonesia juga mulai menerapkan proses persidangan secara elektronik (e-litigasi). Pembaruan hukum melalui e-litigasi selain untuk mendukung pembaruan hukum di era revolusi industri 4.0, juga diharapkan dapat membuat pengadilan menjadi lebih murah, cepat, efisien, dan efektif sesuai dengan asas-asas dasarnya sehingga membuat peradilan menjadi terjangkau oleh seluruh lapisan masyarakat. Namun semenjak diterapkan, e-litigasi kurang diminati para pencari keadilan. Kurang diminatinya e litigasi ini, disebabkan oleh banyak faktor penghambat, beberapa diantaranya yaitu kurangnya standar infrastruktur yang dimiliki, padahal persidangan elektronik sangat bertumpu pada kesiapan infrastruktur seperti fasilitas internet ataupun sarana berupa laptop. Selain itu juga dikarenakan kurangnya kesiapan sumber daya manusia, masih barunya sistem, minimnya informasi di masyarakat, dan belum adanya prosedur tetap yang mengatur e-litigasi secara rinci, salah satunya dalam pembuktian. Pembuktian merupakan hal yang sangat penting dalam persidangan, karena prosesnya yang dilakukan secara elektronik maka diperlukan pencocokan barang bukti yang dimiliki para pihak. Namun dalam PERMA Nomor 1 Tahun 2019 yang mengatur tentang e-litigasi, belum dijelaskan mengenai prosedur pencocokan barang bukti. Tulisan ini membahas mengenai Hambatan Pembuktian dalam E-Litigasi Guna Mendukung Pembaruan Hukum di Era Revolusi Industri 4.0.
This study aims to provide another alternative in resolving conflicts in Lerep Village which is called the District Court (Peradilan Desa). The village court aims to help resolve conflict problems in Lerep Village so that there is no accumulation of cases in the surrounding District Courts. Village justice is carried out by familial mediation between the person in dispute with the head of the local hamlet and the village head. The decisions given are in the form of suggestions from the hamlet head and village head which are not binding. District justice (Peradilan Desa) is a win-win solution to the conflict in Lerep Village. However, the implementation of this District court still has shortcomings. One of them is the district court does not yet have a reference for regulations in its implementation. Another deficiency is the lack of knowledge in the legal field of the parties acting as intermediaries, such as the hamlet head and village head. The research method used in this research is legal research, legal research is often referred to as doctrinal or normative. Normative legal research examines principles, numbers, concepts, rules, laws and regulations, research decisions, agreements and doctrines that are placed by law as a norm system by examining library studies. The conclusion in this study is that specific regulatory references are needed to regulate the running of village courts. And there must be training to provide basic knowledge to the parties concerned.
