This study aims to analyze the law of pesantren axiologically as well as the response of the top academic pro-counter that appears on the birth of pesantren’s law. This research is normative legal research that is the object of study focused on law No. 18/2019 about pesantren. The approach that the authors used is the conceptual approach, this approach aims to find the intent and purpose of such legislation. The data collection method is done by using the method of documentation or library materials, then the data is analyzed by how to describe and perform the axiological analysis. The results of this study are: First, in the axiological study, the birth of pesantren’s law provided many benefits in the form of recognition of equality for students who graduated from pesantren, in recognition of diversity about learning model in pesantren, the governance of independent pesantren as well as recognition of diversity about models and learning methods in pesantren. Second, the emergence of pesantren can provide many benefits for pesantren institution, then the charges which consider that pesantren’s law is government intervention towards the pesantren cannot be justified.
The majority of the Indonesian population who are Muslim with different understandings of Islam is one of the backgrounds for the emergence of new movements that "deviate" in the name of religion. The Transnational Islamic Movement is one of the new Islamic movements that have emerged in several parts of Indonesia, this movement has spread to the Jepara Regency area. Using the qualitative approach used and methods of documentation, interviews, and observations, this paper will describe the Transnational Islamic movement or organization and how the da'wah strategies were carried out in overcoming and dealing with the movement. The results of this study are the strategies used in an effort to overcome the Transnational Islamic movement through a structural approach and the intervention of various parties, both from the da'wah institutions in Jepara Regency, the Indonesian Ulama Council (MUI), Jepara Police, and Islamic Religious Counselors in Jepara Regency so that the organization or The transnational Islamic group, in this case, the Khilafatul Muslimin Ummul Quro group was successfully disbanded. Mayoritas penduduk Indonesia yang beragama Islam dengan pemahaman Islam yang berbeda menjadi salah satu latar belakang munculnya gerakan-gerakan baru yang “menyimpang” dengan mengatasnamakan agama. Gerakan Islam Transnasional merupakan salah satu gerakan Islam baru yang muncul di berbagai wilayah Indonesia, gerakan ini telah menyebar ke wilayah Kabupaten Jepara. Dengan menggunakan pendekatan kualitatif dan metode dokumentasi, wawancara, dan observasi, tulisan ini akan memaparkan gerakan atau organisasi Islam Transnasional dan bagaimana strategi dakwah yang dilakukan dalam mengatasi dan menghadapi gerakan tersebut. Hasil penelitian ini adalah strategi yang digunakan dalam upaya mengatasi gerakan Islam Transnasional melalui pendekatan struktural dan intervensi oleh berbagai pihak, baik dari lembaga dakwah di Kabupaten Jepara, Majelis Ulama Indonesia (MUI), Polres Jepara , dan Penasihat Agama Islam di Kabupaten Jepara sehingga organisasi atau kelompok Islam transnasional dalam hal ini kelompok Khilafatul Muslimin Ummul Quro berhasil dibubarkan.
This research aims to explain how the development and potential of Waqf of Islamic insurance in Indonesia after published the fatwa by DSN-MUI in 2016 concerning the Waqf of insurance benefits and investment benefits in Islamic life insurance. This study uses a qualitative approach and use documentation methods as a data collection technique. All data will be analyzed by describing and making a general sense of the all data about the development of Waqf of Islamic insurance. The results of this research show that Waqf of Islamic insurance developed positively and has potential in the next future with a provision of conceptual and concrete constraints that can impede the development of Waqf of Islamic insurance can be responded to by the management of Waqf and public in general.
The limitation age of marriage in article 7 verse (1) of Law Number 1/1974 on marriage, is considered to cause various problems. The limitation age for marriage of 19 for males and 16 years for females is too early and it is less appropriate with biological, psychological, educational, and economic maturity. Psychologically, marriages under 21 years of age do not yet have maturity. From the aspect of the fulfillment of economic needs, a husband is still not stable to meet family needs.The purpose of this research is to analyze the limitation age of marriage in Law Number 1/1974 by using perspective madzhab qauli fiqh sosial KH . MA. Sahal Mahfudh and analyze the minimum age of marriage in Law Number 1/1974 by using perspective manhaji fiqh sosial KH . MA. Sahal Mahfudh. The results of this research indicate that: First, the madzhab qauli of fiqh sosial sees the limitation age of marriage is too low and not in accordance with the condition that exist in society, and it will cause to adverse impacts. Therefore the preventive effort has to be done, it is in accordance with the rules of fiqh ad-daf'u aqwā min ar-raf'i. Secondly, the madzhab manhaji of fiqh sosial through the the theory of masālikul illat say that the limitation age of marriage in Law Number 1/1974 must be integrated with the purpose of marriage and create al-maslaḥah al-‘āmmah.
Permasalahan Anak Tidak Sekolah (ATS) di desa Tulakan Kabupaten Jepara menjadi persoalan serius yang harus diselesaikan. Persoalan ini secara tidak langsung berpengaruh terhadap menurunnya sumber daya manusia. Untuk merespon dan mengantisipasi peningkatan angka ATS di desa Tulakan, Gerakan Remaja Hebat desa Tulakan bekerjasama dengan UNICEF melakukan suatu program pengabdian. Metode yang digunakan adalah Participatory Action Research (PAR). Pengabdian ini bertujuan untuk mengentaskan angka anak tidak sekolah (ATS) yang ada di Desa Tulakan yang diberi nama Gerakan Remaja Hebat (GRH) dalam Gerakan Remaja Hebat dan berkolaborasi dengan UNICEF. Pengabdian dilakukan dengan penyampaikan materi oleh fasilitator UNICEF selama 10 kali pertemuan. Dari 10 kali pertemuan tersebut 40 anak yang tergabung dalam Gerakan Remaja Hebat (GRH) berproses untuk mengidentifikasi masalah yang mereka hadapi dan mencari solusinya. Bidang Pendidikan dan kewirausahaan menjadi fokus dalam pengabdian ini. Pada bidang Pendidikan mereka membuat kegiatan MABAR (Mari Belajar) dan dalam bidang entrepreneurship atau kewirausahaan adalah membuat produk sederhana yang bisa mereka jual. Produk kewirausahaan yang telah diproduksi ditampilkan dalam Showcase di tingkat Kabupaten Jepara. Hasil pendampingan selama 10 kali pertemauan menunjukkan dampak signifikan bagi ATS dalam peningkatan keterampilan hidup salah satunya adalah entrepreneurship.
