The development and progress of the city of Makassar in line with the occurrence of disturbing conflicts, conflicts and even war between groups provide an overview of research problems regarding the erosion of nationalism, erosion of national ideology, low national character, erosion of local culture, shallow religious values, low sense of solidarity, moral decline , and ethnic fanaticism and declining character quality and declining character quality, all of which have the potential to threaten National Integration and Social Harmony. This research method is descriptive and form of presentation in a systematic, factual and accurate description of the facts obtained. The results showed that conflict/war between groups or residents still occurred in at least six 6 regions in Makassar that had caused various losses because war between groups or residents involved children or adolescents using dangerous objects. There are 30 factors, namely juvenile delinquency, multi aspects, peaceful disturbance, offensive, revenge, social, economic, jealousy, work area disputes, unemployment, ethnicity, religion, culture, wild race, women, competition, misunderstanding, social change, deprivation land, women who seize men (infidelity of women), youth group clashes, politics/parties, deception, social classes/strata, selfishness, arrogance, ridicule, slander, conflict of interest, and government land disputes. Recommendations are needed Conflict Resolution Forum (FOLEKO) as a preventive and repressive measure, provide guidance and counseling for members of the community, about legal awareness, social ethics and courtesy in family life and community life, and inculcation of religious values and national integrity, the authorities need to be more intensive in conducting surveillance and need to carry out routine checks on the possession of dangerous sharp objects, and it is necessary to have the Social Harmony Creation Model module and legal awareness as recommendations of this research.
Tujuan Penelitian ini adalah 1) Untuk mengetahui bentuk konflik yang timbul pada pelaksanaan pengadaan tanah bagi pembangunan untuk kepentingan umum di Kabupaten Maros setelah pemberlakuan Undang-undang No. 2 Tahun 2012 tentang Pengadaan Tanah dan 2) Untuk mengetahui bentuk penyelesaian konflik dalam pelaksanaan pengadaan tanah bagi pembangunan untuk kepentingan umum di Kabupaten Maros. Penelitian ini berbentuk socio legal research. Hasil penelitian menunjukkan bahwa 1) Bentuk-bentuk konflik dalam pelaksanaan pengadaan tanah bagi pembangunan untuk kepentingan umum adalah konflik horizontal yakni konflik yang melibatkan dua pihak atau lebih di mana pihak-pihak yang terlibat tidak berada dalam keseimbangan kedudukan. Konflik ini terjadi karena faktor substansi hukum yang multitafsir, inkonsistensi pelaksanaan tugas dari penyelenggara pengadaan tanah dengan ketentuan dalam Undang-undang Pengadaan Tanah dan kurangnya pemahaman masyarakat mengenai pengadaan tanah. 2) Bentuk penyelesaian terhadap konflik pengadaan tanah dilakukan melalui harmonisasi substansi hukum, sinkronisasi antar sektor dalam pengambilan keputusan, redefinisi beberapa konsep pengadaan tanah dan sosialisasi hukum pengadaan tanah kepada masyarakat, sosialisasi hukum kepada masyarakat. The objectives of this study are 1) To determine the form of conflict that arises in the implementation of land acquisition for development in the public interest in Maros Regency after the enactment of Law No. 2 of 2012 concerning Land Acquisition and 2) To determine the form of conflict resolution in the implementation of land acquisition for development in the public interest in Maros Regency. This research is in the form of socio legal research. The results showed that 1) The forms of conflict in the implementation of land acquisition for development of the public interest are horizontal conflicts, the conflicts involving two or more parties in which the parties involved are not in a balanced position. This conflict occurred due to the substance of the law which has multiple interpretations, inconsistency in the implementation of the duties of the land acquisition organizer with the provisions in the Land Acquisition Law and the lack of public understanding of land acquisition. 2) The form of resolution of land acquisition conflicts is carried out through harmonization of legal substance, synchronization between sectors in decision making, redefinition of several land acquisition concepts and socialization of land acquisition law to the community, and socialization of the law to the community.
Pembangunan perekonomian nasional pada era globalisasi harus dapat mendukung tumbuhnya dunia usaha sehingga mampu menghasilkan beraneka barang dan/ jasa yang memiliki kandungan teknologi yang dapat meningkatkan kesejahteraan masyarakat banyak dan sekaligus mendapatkan kepastian atas barang dan/jasa yang diperoleh dari perdagangan tanpa mengakibatkan kerugian konsumen. Pada sisi lain bahwa dengan semakin terbukanya pasar nasional sebagai akibat dari proses globalisasi ekonomi harus tetap menjamin peningkatan kesejahteraan masyarakat serta kepatian atas mutu, jumlah dan keamanan barang dan/ atau jasa yang diperolehnya di pasar. Berdasar itu untuk meningkatkan harkat dan martabat konsumen perlu meningkatkan kesadaran, pengetahuan, kepedulian, kemampuan dan kemandirian konsumen untuk melindungi dirinya serta menumbuh kembangkan sikap perilaku usaha yang bertanggung jawab. Bahwa berdasarkan berbagai hasil penelitian, masih ditemukan banyak pelaku usaha yang melanggar berbagai larangan yang tercantum dalam peraturan perundang-undangan, khususnya UU No.8 Tahun 1999. Pada sisi lain konsumen pada umumnya tidak memahami haknya sehingga cenderung dirugikan oleh pelaku usaha, bahkan cenderung tidak berdaya menghadapi kekuatan financial yang dimiliki oleh pelaku usaha. Oleh karena itu berbagai hal yang harus diperhatikan dalam undang-undang perlindungan konsumen baik oleh pelaku usaha maupun para konsumen.
Every ship that is going to sail is required to have a sailing approval letter issued by the harbormaster as an effort to control the security and safety of shipping. This research is a normative-legal research using a statute, comparative and conceptual approaches.The results show that the harbormaster as a government official at the port carries out and supervises efforts to fulfill shipping safety and security as a government administrative action by issuing a state document in the form of a sailing approval letter through a system of procedures for issuing a sailing approval letter. This letter is given to every ship that will sail or leave the port by ensuring that the ship, crew and cargo have technically-administratively fulfilled all sailworthiness requirements. The compliance of all parties in implementing the procedure for the issuance of the sailing approval will lead to the achievement of safety and security in shipping.
