The existence of refugees in Indonesia requires serious attention. Social conflict can arise due to psychological pressures as people who are not allowed to work when they need the cost of living, should not go to formal school even though the provision of science is expected changing the future, health services are only obtained from NGOs partners UNHCR, also prohibited owning property. This is done by the Indonesian government in order to protect and prioritize the rights of its citizens over foreign nationals. However, as a country that signed The Declaration on Human Rights (although it did not ratify the 1951 Convention and the 1967 Protocol on the Status of Refugees), Indonesia has a moral obligation to help fellow human beings by providing temporary shelter and life support which is certainly not permanent and far from sufficient. The active role from the Security Council of United Nations to immediately realize peace in war conflict areas is the main solution, rather than simply waiting for third countries to raise quotas to accept refugees.

This study aims to analyze the function of immigration in the security aspect, namely as a guard at the entrance to the territory of Indonesia during a pandemic. This function is of course very urgent considering that currently the spread of the Covid 19 virus is getting out of control, one of which is because there are still many foreigners entering Indonesian territory. The research method used is juridical normative, namely analyzing library materials or tracing documents related to the problem under study. The approach used is a statutory approach and a conceptual approach. The results showed that the actualization of the role of the immigration function during a pandemic can be seen from the aspect of immigration regulation and practices carried out by immigration checkpoints (ICP) throughout Indonesia. Meanwhile, the ICP has carried out its function as guardian of state security with the arrival of foreigners and closed several ICPs to limit immigration traffic. There is a significant difference in law enforcement during normal times and during the pandemic, namely the concessions given to foreign nationals in the form of changing overstay fees and deportation cannot be carried out. Deportation cannot be done because in general the person's home country also applies, so temporarily when foreigners who cannot return to their home countries stay in detention centers.

Oversight of foreigners becomes very important in line with the increase in international crime, one of which is a narcotics crime. Through technological developments, the spread of narcotics has reached almost all regions in Indonesia. The state does not want its territory to have people involved in narcotics crimes. The main objective of the supervision of foreigners is to protect the community and the sovereignty of the State. The aim of the study to analyze who has authorized to conduct surveillance of foreigners related to narcotic crimes. This research is a normative legal research using the legislation approach and concept approach. The results of the research are: The authority to supervise foreigners related to narcotics criminal acts based on the Immigration Act is carried out by the Minister by forming a team consisting of relevant government agencies or agencies both at the central and regional levels. The institution is the Immigration Agency and is also carried out by the National Narcotics Agency which coordinates with the Police. Furthermore, based on the Law on narcotics that is authorized to conduct surveillance of Narcotics crime as regulated under the provisions of Article 61 paragraph (1) is the Government. The government supervises all activities related to Narcotics.. Oversight of Foreigners related to narcotics crime, is not only done when they enter, but also while they are in the Territory of Indonesia, including their activities. Immigration Supervision covers the enforcement of immigration law, both administrative and Immigration.
