Pembentukan Holding BUMN, termasuk Holding Perkebunan Nusantara merupakan upaya dalam rangka meningkatkan nilai tambah BUMN. Terbentuknya Holding Perkebunan Nusantara mengakibatkan terjadinya perubahan status badan hukum BUMN, khususnya dalam hal ini terhadap PT Perkebunan Nusantara V. Ketentuan terkait pembentukan Holding Company pada BUMN belum diatur secara jelas dan spesifik dalam bentuk Undang-Undang.Pasca terbentuknya Holding Perkebunan Nusantara, mengakibatkan hilangnya status BUMN Persero di PTPN V dan kedudukannya menjadi anak perusahaan BUMN, yang ditandai dengan terjadinya restrukturisasi organisasi perusahaan, perubahan komposisi dan jenis saham, yaitu menjadi 90% saham dimiliki oleh PTPN III (Persero) dan 10% saham dimiliki oleh negara, dengan klasifikasi kepemilikan saham istimewa atau dwiwarna. Adanya pengendalian induk terhadap anak perusahaan dalam konstruksi perusahaan grup mengakibatkan dualitas pada anak perusahaan, yaitu selaku badan hukum mandiri dan badan usaha yang tunduk di bawah pengendalian induk perusahaan.Namun, masih terdapat multitafsir atau perbedaan pendapat terkait dengan kedudukan dari keuangan BUMN, apakah keuangan BUMN termasuk dalam lingkup keuangan negara, atau sebaliknya keuangan BUMN bukan merupakan keuangan negara. Disharmonisasi hukum ini antara lain ditandai dengan adanya perbedaan dalam ketentuan perundang-undangan, pandangan atau pendapat para ahli, dan putusan pengadilan. Berdasarkan prinsip Separate Legal Entity dan transformasi kekayaan negara, pada hakikatnya telah terjadi perubahan status hukum kekayaan negara menjadi kekayaan BUMN ataupun anak perusahaan Holding BUMN yang terpisah dari pemegang sahamnya, namun masih tetap mempunyai hubungan dengan negara dikarenakan status negara selaku pemegang saham dengan hak istimewa. Jenis penelitian yang digunakan dalam tulisan ini adalah penelitian hukum yuridis normatif, yaitu deskriptif analitis. Menggunakan data sekunder meliputi bahan hukum primer, sekunder, tersier yang dikumpulkan dengan penelitian kepustakaan, dan selanjutnya dianalisis dengan metode kualitatif. Penelitian ini dilakukan di PT Perkebunan Nusantara V yang berlokasi di Kota Pekanbaru, Provinsi Riau.

Abstrak Kabupaten Rokan Hulu terkenal akan wisata religinya yaitu masjid Islamic Center Madani yang dikunjungi oleh ribuan pengunjung dari berbagai daerah setiap minggunya. Sebagai penunjang ciri khas daerah wisata religi, pihak manajemen merencanakan pembudidayaan tanaman kurma yang diinspirasi oleh Kitab Suci al-Qur'an untuk meningkatkan pendapatan dan kesejahteraan masyarakat Desa Babussalam. Terkait dengan tanaman kurma yang relatif baru di Indonesia, diperlukan sosialisasi tentang potensi tamanan kurma dan konsep peraturan desa yang terkait dengan konsep green constitution. Sosialisasi dilakukan kepada perangkat Desa Babussalam Kecamatan Rambah Kabupaten Rokan Hulu untuk merintis program budidaya tanaman kurma melalui peraturan desa. Diharapkan dapat meningkatkan taraf hidup masyarakat desa Babussalam sekaligus sebagai desa percontohan budidaya kurma. Indikator kegiatan ini yaitu terwujudnya peningkatan pengetahuan dan motivasi, tingkat partisipasi, kesesuaian materi, dan faktor dampak implementasi kegiatan lebih lanjut. Berdasarkan indicator tersebut, Desa Babussalam dinilai berhasil dan dapat meningkatkan pengetahuan, motivasi dan kesiapan perangkat Desa dalam mempersiapkan peraturan desa sebagai implementasi green constitutiondalam budidaya tanaman kurma sebagai trademark kabupaten Rokan Hulu sebagai daerah tujuan wisata religi.Abstract Rokan Hulu Regency is famous for its religious tourism, namely the Islamic Center Madani mosque which is visited by thousands of visitors from various regions every week. As a support for the characteristics of religious tourism areas, the management plans to cultivate date palms inspired by the Holy Qur'an to increase the income and welfare of the people of Babussalam Village. Related to the relatively new date palm plants in Indonesia, socialization of the potential of date palms and the concept of village regulations is needed relating to the concept of green constitution. The socialization was carried out to Babussalam Village officials in Rambah Sub-District, Rokan Hulu District to initiate a program to cultivate date palms through village regulations. It is hoped that it can improve the standard of living of the people of Babussalam village as well as a pilot village for date palm cultivation. Indicators of this activity are the realization of an increase in knowledge and motivation, the level of participation, the suitability of the material, and the impact factors for the implementation of further activities.
Indonesia is a lawful welfare state, which means that the governmenthas a duty and responsibility in realizing the social justice and thegeneral welfare of the people. Paragraph (1) of the 1945 Constitution,stated that The State must ensure the implementation of equality in thestanding before the law. Nowadays it seems only the lower class thatmust obey the law, while the upper class seems to be immune to thelaw. They are hiding from the law behind the layers of their ownmoney. As if the law can be sold using money, even for those whocommit major crimes, corruption for example. While the lowerclasses who commit minor crimes can be imprisoned. Our country is acountry of law, then the law should be enforced, for all people and notjust for Reviews those who have the money. To realize theimplementation of the idea of a lawful welfare state then the Stateshould guarantee the right of every person to reach justice. In otherwords, the State must guarantee the implementation of legal aid to theimpoverished or Reviews those who cannot afford so that nonehas no access to justice that is mandated by the constitution. Legal aidadvocacy for the impoverished in the concept of a lawful welfare stateis certainly to be important in realizing the ideals of the lawful welfarestate that achieve social justice and general welfare of thepeople. Therefore, it is important to know the concept of advocacysuitable for the impoverished in a welfare state.
